Cancellation conditions
To exercise the right to cancel, you must inform RSB window of the decision to cancel the contract by a clear statement (e.g. a letter sent by post or e-mail) quoting your name, address and the quotation reference within 14 days of accepting the quotation.
If you cancel the contract, RSB windows will reimburse all payments received from you, excluding the cost of bespoke products (designed and manufactured to customer specification) which will remain due for any payment. If the Survey has taken place and the windows or doors have been ordered by RSB windows, a further 10% of the job value will be required in order to cover these services.
Standards of all glass supplied by RSB windows will meet guidelines set out by the Glass and Glazing Federation UK.
1. In these conditions of sale, RSB windows means as per the details in the header. The “Customer” means the person, firm or company from whom RSB windows accepts an order. “Goods” means goods or services which are subject of such an order be it placed verbally or in writing.
2. The Customer agrees to purchase and have installed the Goods specified in the form of an order.
3. Orders are individually manufactured. Any Goods not used in their intended location in the Customer’s premises cannot be credited against the contract price.
4. The total outstanding balance is payable within 48 hours, unless the goods or services are deemed to be not fit for purpose.
5. Once you confirm acceptance of the quotation and payment of the Deposit has been received in cleared funds, we will arrange for a Survey to take place on those areas of the Site which directly relate to the proposed work. A copy is available on request, but we will not automatically provide you with the Survey information.
If you wish to cancel your order and receive a refund of your Deposit you must notify RSB windows before the Survey is carried out.
Once the Survey has been carried out you will be committed your order for the Goods.
6. If it becomes apparent that there are aspects that were not identified at the time of the original estimation, the Survey identifies problems with the structure, dimensions, access to the Site or other technical problems, or in the event that the proposed works are contrary to Building Regulations and/or other relevant legislation or in the event that the surveyor’s measurements differ from those of the estimator which results in the requirement to increase the Price, then we may, at our option:
quote a price for any additional work required to enable us to carry out the proposed installation work and issue you with a variation form to sign, without obligation on your part; or
give you notice to terminate the Purchase Order and refund your Deposit
7. The Customer hereby acknowledges that the items and diagrams in this contract have been checked and are correct.
8. Risk shall pass to the Customer when Goods leave the RSB windows premises where the Customer collects. Risk shall pass to the Customer when RSB windows has installed agreed goods.
9. Notwithstanding that the risk in the Goods has passed to the Customer, the ownership of the Goods shall remain with RSB windows which reserves the right to possession and to dispose of the goods until such time that payment has been received in full by RSB windows and cleared through the Company’s bank account.
10. RSB does not deem the contract complete for the purposes of ordering a FENSA Certificate until the Customer has paid in full.
11. The Customer agrees to permit access to RSB windows and its workers to the installation address at all reasonable times so that RSB windows may carry out the works scheduled.
12. The Customer agrees to permit access to RSB windows and its workers to the installation address for remedial work after the originally scheduled installation date to either, complete the installation if more time is required, rectify customer complaints, repair or replace items if required, or re-do work to customer satisfaction.
13. RSB windows can not be held liable for any consequential loss for circumstances detailed in item 12 of this document.
14. The Customer will provide the free use of a reasonable amount of water and electricity.
15. The Customer will provide parking on a driveway or a valid permit if the road is ‘permit holders only’.
16. RSB windows will take all reasonable care of the Customer’s property when carrying out the work. Any damage to plaster, render, masonry will be repaired to a specialist finish excluding decorating/painting. RSB windows cannot accept liability for re-decoration.
17. The quotation price does not include for the repair or replacement of any rotten timber, defective lintels, hidden services or hazardous materials such as asbestos found during the course of carrying out the works or for the repair otherwise of any other structural defects unless such work is specified in the schedule of work. Any such work found to be necessary will be brought to the attention of the Customer and will be the subject of a separate quotation.
18. RSB windows does not undertake to move services, fixtures or fittings which are ancillary to the basic structure of the property, e.g. radiators, pipes, electricity, telephone or television cables and the Customer shall remove all household fixtures, including curtains, nets and blinds before the installation is due to commence. RSB windows does not take any responsibility for damage caused to any of the above, if not removed by the Customer while work is executed. RSB windows reserves the right to charge for wasted time if it is unable to carry out work due to site-specific restrictions/conditions.
19. No undertaking can be given that the Customer’s existing doors, windows and/or frames can be removed so as to be fit for re-use or any other purpose and they will be removed from the site and disposed of unless the Customer instructs the installer to leave them. Every effort will be made to protect and clean working areas as best as practicable, but RSB windows cannot be held responsible for small fragments /splinters/ particles, which may still be present.
20. RSB windows reserves the right to make minor variations in the specification of any of its products at its discretion and without prior notice to the Customer, in keeping with the Company’s policy of continuous development and improvement. Any specification changes will be of an equal or improved product standard.
21. Any product guarantee will come into effect immediately upon completion of the works provided that the full price has been received (less any appropriate amount in the event of defects) by RSB windows on the due date.
22. The delivery or installation period quoted is that anticipated at the time of the order and will be improved on if possible. In the event that this contract is not completed within the specified delivery period, the Customer may serve notice on RSB windows in writing, requiring that the work be carried out and completed within six weeks. If the work is not completed within such expended period, the Customer may cancel the uncompleted work covered by the contract without penalty on either side and without loss of any deposit paid by serving written notice by recorded delivery post or via email to RSB windows.
23. RSB windows’ liability to the Customer in respect of the direct or indirect consequences of any breach or non-performance howsoever caused or of the strikes or of lock-outs or of any other circumstance beyond RSB windows’ control or of non-supply by a third party or arising out of negligence or of any misrepresentation or of force majeure or of any other tort or breach of statute by RSB windows, its employees or its agents shall be limited to the price of the goods which are subject matter of the particular order. RSB windows reserves the right to treat the contract as at an end with no compensation payable to the Customer.
24. RSB windows does not claim or guarantee that its products eliminate or even reduce the incidence of condensation.
25. RSB windows will, at its sole discretion, repair or replace all goods that are or become defective by reason of faulty materials or workmanship in line with our written guarantee.
26. RSB windows may use sub-contractors for specific aspects of the work to be completed.
27. In the event of a dispute between the parties the customer shall agree to use, and be bound by the terms of, the dispute resolution services provided by RSB windows’ Certification Body or Competent Person Scheme Operator
28. Nothing in these terms and conditions shall be interpreted as excluding or restricting the statutory rights of the Customer.
29. The formation, construction and performance of this agreement or shall be governed in all by English Law.
